FERC rejects ComEd’s cancellation of PowerHouse Hillwood data center contract

September 23, 2026 · Utility Dive · Score: 16

Federal regulators have blocked Commonwealth Edison's attempt to cancel a contract with PowerHouse Hillwood, the developer behind a massive 1.8-gigawatt, $20 billion data center planned for Joliet, Illinois. The Federal Energy Regulatory Commission (FERC) said the dispute over the contract's terms should be settled in federal court instead, where the case is already pending.

At the center of the fight is how much financial backing the developer put up to secure the deal: just $1. One FERC commissioner called that "an embarrassing legal fiction" that shifts risk onto ratepayers and the power grid rather than the company building the project. Other commissioners used the case to argue for clearer, more consistent rules on how large power users like data centers get connected to the grid and how much financial security they should provide upfront.

This case does not involve homeowner utility bills directly, but it points to a bigger trend worth watching: as data centers multiply and demand more electricity, regulators are working out who bears the cost and risk of building the infrastructure to serve them. FERC has given regional grid operators until mid-November to propose new rules on this. How those rules shake out could eventually affect electricity rates and grid reliability in areas with heavy data center growth, though nothing here changes anything for homeowners right now.
