Elon Musk Fails In His Attempt To Subvert First Amendment Considerations For Social Media

August 28, 2026 · CleanTechnica · Score: 0

This story is about social media policy and courts, not home energy upgrades, so there's nothing here that affects your house or any rebate program.

For context: a federal judge dismissed a lawsuit that Elon Musk's company X Corp. brought against New York state over its "Stop Hiding Hate Act." That law requires large social media companies to report how they define and handle hate speech, extremism, disinformation, and similar content on their platforms. X argued the law violated free speech protections, but Judge John Cronan ruled that requiring companies to disclose their own moderation practices does not violate the First Amendment, since it only makes companies "speak truthfully about their offerings." X had previously won limits on a similar California law.

Separately, Musk's AI company xAI is suing Minnesota over a new state law banning "nudification" technology, which lets users create fake nude images or videos of real people without consent. Minnesota's law allows penalties of $500,000 per violation. xAI says it doesn't oppose banning nonconsensual deepfake images generally, but argues the law goes further than that and restricts protected speech.

Neither case has anything to do with energy efficiency, weatherization, or home rebate programs. If you're tracking those topics, this article won't change anything about your plans.
